Information note on the processing of personal data of candidates

    The company RENANIA TRADE S.R.L., Romanian legal entity, with its registered office in Targu-Mures, str. Dezrobirii, no. 19, Romania, registered at the Mures Trade Register Office under no. J26 / 822/1995, CUI RO8006912, represented by General Manager Florentina Taudor,

    named to as „the Operator

    in accordance with the provisions of Regulation (EU) no. 679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (named as „Regulation”),

    provides you below with information on the processing of personal data for the purpose of personal recruitment

  2. CATEGORIES OF PERSONAL DATA

    The Operator processes your personal data, in your capacity as a candidate for the positions opened within the organization of the Operator (named as „Target Person„), under the conditions described in this information, as follows:

    1. personal contact and identification data: name, surname, home address, residence, date of birth, telephone number and email address, nationality, citizenship, in the first part of the recruitment process and if we arrive with you. at an advanced stage (communication of the offer, for example) of recruitment in order to be contracted, the identity card or passport, data such as CNP, serial number and number of the CI / Passport, or other necessary identification data will be requested for this purpose;
    2. data that allow the verification of the eligibility and selection conditions related to the recruitment process: study documents (eg: baccalaureate diploma, bachelor's degree, master's degree, doctorate, etc.), professional certificates / certificates or certificates issued by the regulatory authorities, job-specific qualifications / certificates, country visas, references, interview notes, records / results of pre-employment checks, information included in the CV of the data subject and / or in any application form;
    3. data regarding the professional examination of the data subject: references, interview notes, records / results of the data subject's verifications, professional experience, performance analysis and evaluation, performance improvement plans and related correspondence; During the recruitment process, the data subject will take general and / or specific tests, in accordance with the requirements of the job and will participate in discussions / interviews with company employees regarding the level of training of the person, related to the requirements of the job / field and in order to identify and select the most suitable candidate. The results of the general and / or specific tests, those of the interviews, the discussions will be used by the company exclusively for the purpose of identifying and selecting the most suitable candidates.
    4. data regarding the remuneration : such as the one from the job offer and data regarding the corresponding transfer of the contributions to the state budget by the previous employer;
    5. health data: information on the medical condition of the data subject, details on possible disabilities or work restrictions;
    6. data regarding the discipline of the data subject at work: information regarding the possible behaviors in the work environment of the data subject and / or disciplinary procedures in which he / she was involved;
    7. data collected from the video surveillance of the access roads in / from the Operator's premises, for the safety and security of the access, for the guarding and protection of the goods and of the persons respectively.
  3. DATA SOURCE

    We collect your personal data directly from you, at our headquarters and at our offices in the country, physically or by e-mail, from recruitment applications accessed and / or used by you (eg eJobs), from the recruitment companies you turned to for employment, from the recruitment and personal supply service providers, respectively, as the case may be.

    At the same time, you provide us directly with personal data through the CV submitted for employment, through requests / communications / personal data provided in the recruitment process.

  4. BASIS AND PURPOSES OF PERSONAL DATA PROCESSING:

    1. Processing activities are performed, based on ensuring a legitimate interest of the Operator (legal basis)for the following purposes:
      1. realization the process of selection and recruitment of the Target Persons in order to be hired, analyzing the conditions of employment or promotion;
      2. scheduling and conducting the job interview, elaboration of the short list of Target Persons that are closest to the requirements of the open position;
      3. preservation of the Operator's right to defense;
      4. video surveillance in order to ensure the protection of goods and persons, to guarantee the security of information systems.
    2. Processing activities are carried out, based on carrying out steps in order to conclude the employment contract (legal basis)for the following purposes:
      1. adopting the final decision of the Operator regarding the employment of the Target Person, as well as providing positive / negative feedback;
      2. preparation of employment documentation in case of positive feedback and then acceptance of the offer.
    3. Processing activities are performed,, based on the fulfillment of a legal obligation (legal basis)for the following purposes such as:
      1. in view of the preliminary examination of the Right / Work Permit in Romania of the Concerned Person;
      2. for reporting to the competent authorities and bodies, if applicable by law;
      3. carrying out reporting / communication with authorities / institutions with control / supervision / monitoring attributions, if in accordance with the applicable legal provisions it is the case
    4. Processing activities are performed, based on the consent of the data subject (legal basis), if it has been obtained, for the following purposes:
      1. storage of personal data, of the Persons Concerned in subsequent specific recruitments, without this storage giving rise to the Operator any obligation to select, respectively to contract with the candidate.
  5. DURATION AND CONDITIONS OF DATA PROCESSING:

    For the purposes related to the human resources activity, your personal data will be processed, if necessary stored, for a limited period of time in a safe place and in accordance with the legal conditions and provisions, as follows:

    1. during the recruitment process, until the moment of hiring for the candidate who based on the respective recruitment will enter into a contractual legal relationship with the Company, following that, after his employment, the processing of data communicated for recruitment will be done by the Company in the purpose of keeping records in order to contract / carry out the contractual legal relationship that intervened with the Company;
    2. for a period of 3 (three) years years from the date of registration of the candidature of the data subject, in case the latter has expressed his / her consent according to art. 4 point IV and if he has not exercised the right to withdraw his consent within the term of 3 (three) years, in which case the period will be limited accordingly in this respect;
    3. personal data are deleted as soon as the decision of the Operator is negative regarding the employment of the Data Subject, except for the situation provided by art. 4, point IV, when the data subject expresses his / her express consent regarding the data processing after the end of the recruitment process, at art. 4 point I. sub-point iii and art. 4 point III sub-points ii and iii, in case the applicable legal provisions oblige the data processing but limited to the duration imposed by the normative acts in this respect.

    Throughout the processing of personal data, the Operator informs the data subject that he ensures compliance with the applicable legal provisions regarding the confidentiality of data, the application and compliance with technical and organizational measures and safety and security requirements in this field.

  6. RECIPIENTS:

    We disclose your personal data mentioned above to the following categories of recipients (other operators, associated operators or proxies of the operator)

    1. to other companies, entities that provide various support services for the Operator in order to carry out our activity (such as personnel recruitment services, IT services, systems / database maintenance services, security and protection services, etc.);
    2. to the state authorities such as ITM, fiscal authority, ANSPDCP, etc. based on their competencies provided by the applicable law;
    3. internally to the employees of the Company who have obligations to maintain the complete confidentiality of the data and respectively to respect the internal norms and procedures of the Company and in this sense.
  7. TRANSFER OF PERSONAL DATA:

    At this time, RENANIA TRADE has contracted specialized online / cloud services for electronically stored data, for which RENANIA TRADE uses the services of a specialized supplier based in Ireland and its intermediary, based in Germany, on a contractual basis, with express clauses. from the perspective of the General Regulation on data protection, including with the indication of the provisions of art. 46 of the above-mentioned regulation.

  8. RIGHTS OF THE TARGETED PERSON:

    We would also like to inform you that, according to the Regulations, for the personal data in your relationship with the Company for the main purpose of recruitment, you have the following rights:

    • the right of access to your personal data, ie your right for the Operator to inform you whether or not it processes your personal data and, if so, to ensure your access to those data; for this purpose, the Operator will provide, free of charge, a copy of the processed data and will provide you with all the information provided by the Regulation;
    • the right to rectify and complete the data, respectively,, your right for the Operator to correct your inaccurate data and / or to fill in the missing data;
    • the right to delete data („the right to be forgotten„), your right for the Operator to delete your personal data in the following cases:
      1. those data are no longer necessary for the purposes for which they were collected or processed;
      2. withdraw your consent on the basis of which the processing takes place and there is no other legal basis for the processing;
      3. you oppose to the processing of personal data and the Operator has no legitimate reasons to prevail over your rights regarding the processing of such data;
      4. you oppose to the processing of your personal data for commercial / advertising purposes (direct marketing);
      5. if your data has been processed illegally;
      6. personal data must be deleted in order to comply with a legal obligation of the Operator.

      stating that, in accordance with the provisions of Article 17 of the Regulation, there may be situations (such as the exercise of a right in court, for example) in which the Operator will not be able to comply with your request.

    • the right to restrict data processing, under the following conditions:
      1. if you dispute the accuracy of your personal data held by the Operator (the restriction will take effect for a period that will allow us to verify the accuracy of that data);
      2. if the processing is illegal but you do not want to delete the personal data, requesting only the restriction of their use;
      3. The operator no longer needs the respective data for the purpose of processing them, but you request them for us to capitalize on a right in court;
      4. if you oppose to the data processing, the restriction will take effect for the time necessary to verify that the rights of the Operator prevail over your rights.
    • the right to data portability - the right to receive personal data that you have provided to us, that we process and that we preserve in an electronic format; therefore, you do not have the right to receive data stored by us on paper; you have the right to receive this data in a structured format, commonly used and which can be read automatically; the data thus received may be stored by you, may be transmitted to another operator or, at your request, we may transmit them to the operator you indicate to us, if this is technically feasible.
    • the right to object - the right to object at any time to the processing of your personal data, for reasons related to your particular situation; The controller will no longer process your data, unless it proves that it has legitimate and compelling reasons justifying the processing and prevailing over your interests, rights and freedoms or that the purpose of the processing is to exercise a right in court.
      In order to avoid any doubt, we specify that your personal data processed on the basis of the reasons mentioned above and for the purpose of recruitment are not subject to processing for marketing purposes by the Operator.
    • the right to withdraw your consent for processing - you may withdraw your consent at any time to the processing of personal data that is processed under your agreement, free of charge; if you withdraw your consent, the processing of your data carried out before the withdrawal of consent will remain legal;
    • the right to obtain human intervention from the Operator, to express your point of view and to challenge the decision taken by the Operator exclusively automatically. For the avoidance of doubt, we hereby inform you that at this date Renania does not process any processing exclusively by automatic means of making a decision regarding you (the person concerned).

    In order to exercise any of these rights in relation to the Company, you can contact the Operator / Company Renania Trade SRL by a written request, to the attention of the Human Resources Department - or by email at dpo@renania.ro.
    Your request will be analyzed and answered within the time limit provided by the Data Protection Regulation.

  9. COMPLAINTS REGARDING THE PROCESSING OF PERSONAL DATA

    The operator has the obligation to provide you with information on the actions taken as a result of exercising the rights indicated above, without undue delay and, in any case, within one month from receipt of the request. In the case of complex or very large applications, this period may be extended by two months. In this case, we have the obligation to inform you about such an extension, within one month from the receipt of the request, also presenting the reasons for the delay.

    If the Operator notifies you of the decision not to take action in connection with your request or if the response received from the Operator is unsatisfactory, you have have the right to file complaints:

    • at the National Authority for the Supervision of Personal Data Processing (A.N.S.P.D.C.P.),  based in G-ral Blvd. Gheorghe Magheru 28-30, Sector 1, postal code 010336, Bucharest, in the form of a written address, at the institution's headquarters or by e-mail at anspdcp@dataprotection.ro;
    • the competent court.
